THE Office of Local Government (OLG) is investigating a code of conduct matter against Moree Plains Shire councillor John Tramby.

The matter related to an incident involving Cr Tramby at the ordinary council meeting on April 10 where he allegedly made derogatory statements to councillors and council staff.
During last month’s ordinary meeting Cr Tramby was given an opportunity to retract his comments and apologise, which he did not agree with.
He argued that the comments recorded by the council during the meeting were not his words and therefore he would not retract what was on record.
“I am prepared to retract the statement I made, but the statement I made and the one recorded in the minutes are different and not correct,” he said during the meeting.
An OLG spokesperson confirmed a referral was received from the Moree council relating to an alleged failure by Cr Tramby to comply with a council resolution.
“As such, these matters must be referred to the OLG for consideration under the misconduct provisions of the Local Government Act 1993,” she said.
“This referral has been made in accordance with the Procedures for the Administration of the Model Code of Conduct, which are available on the office’s website. The complaint will be assessed to determine whether further action needs to be taken. The actions available to the chief executive should misconduct be found are provided at section 440I of the Local Government Act,” the spokesperson said.
