Donald Trump's campaign has filed lawsuits in Pennsylvania, Michigan and Georgia and demanded a recount in Wisconsin.
They are laying the groundwork for contesting battleground states as Trump slipped behind Democrat Joe Biden in the hunt for the 270 Electoral College votes needed to win the White House.
But it's groundwork that might not pay off; it's not easy to persuade judges to undo an election once the votes have been counted.
Biden is preparing for the fight, creating a "Biden Fight Fund", asking for donations to help pay the costs involved in a recount.
"Donald Trump does not decide the outcome of this election and nor do I. The American people decide," he tweeted.
At the time of publication, Trump had 214 of the Electoral College votes and Biden 253, according to The New York Times.
Staying in New York and police have arrested more than 20 people following demonstrations where protesters demanded a thorough count of ballots, called for racial justice and criticised police.
In Portland, Oregon, police labelled protesters smashing storefront windows as a riot and swarmed in; hundreds blocked the Interstate 94 in Minneapolis, while protests also popped up in Chicago, Philadelphia and elsewhere The New York Times reported.
While tensions heat up, we still await crucial counts in the swing states of Pennsylvania, Nevada, Georgia and Arizona.
The race now hinges on them, and while we might find out the results of some of those states tonight, we definitely we won't know results from Nevada until 4am AEDT Friday, as they aren't reporting the count until then.
In this tight race the announcement of the next president could still be a sleep away.
