Patrick Allan Boon is accused of killing Fred Tuffs on June 13, last year, at the worksite off Culgoora Road at Wee Waa, where they were both working.
Boon has been in custody since the day of his arrest and appeared in Moree Local Court where Magistrate Michael Dakin was told a statement was still outstanding in the brief of evidence.

Boon is yet to enter a plea to the charges of murder and wounding a person with intent after allegedly attacking Mr Tuffs, 57, with a wrench and a sledgehammer.
Mr Tuffs died in hospital from massive head injuries.
Mr Daikin ordered police to serve the forensic police officer’s statement by the end of the month, marking the case for committal in April meaning Boon’s defence will need to outline whether the case will head to trial or sentence in the NSW Supreme Court.
He made no application for bail and it was formally refused.
The case returns to court in April.
